Arbitration

1. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to your use of this Mid-Term Mastery program offered by HobKnob, including but not limited to issues related to access, content, or payments, shall be resolved through arbitration. This arbitration policy is intended to provide a fair and efficient alternative to traditional litigation.

2. Arbitration Process

The arbitration shall be conducted in accordance with the rules of Indiana, and the arbitration proceedings shall take place in Jeffersonville, IN unless otherwise agreed upon by both parties. The arbitrator's decision shall be final and binding, and judgment on the arbitration award may be entered in any court having jurisdiction.

3. Waiver of Class Actions

You and HobKnob agree that any arbitration shall be conducted on an individual basis only and not on a class, collective, or representative basis. You waive any right to assert any claims as a representative or member in any class or representative action.

4. Governing Law

This arbitration policy shall be governed by and interpreted in accordance with the laws of Indiana, without regard to its principles of conflicts of law.

5. Costs and Fees

Each party shall bear their own costs and fees associated with the arbitration, including attorney fees. The prevailing party may be entitled to recover its reasonable attorney fees and costs from the non-prevailing party.

6. Exceptions

Nothing in this arbitration policy shall prevent either party from seeking injunctive relief in court to prevent the unauthorized use or infringement of intellectual property rights, or any other action that would cause irreparable harm.

7. Opt-Out

If you do not wish to be bound by this arbitration policy, you must notify HobKnob Co-Living within 10 days of first accessing this Mid-Term Mastery program. Such notice should be sent to Brian.Rios@StayHobKnob.com. Your notice must include your full name and a clear statement that you wish to opt out of the arbitration policy.

By using any part of this Mid-Term Mastery program, you agree to this arbitration policy and consent to resolve any disputes through arbitration as outlined above.
